NONIMMIGRANTS

The non-visa exempt aliens seeking entry to the U.S. may generally obtain a visa at a U.S. embassy or consulate abroad by submitting the DS-156 form (sometimes electronically).  Certain candidates need to fill out the DS-157 form.  Fingerprints will be required as well as a personal appearance in the consulate outside of the U.S.  Please note that consular officers may consider all available information, including hearsay in determining whether a reasonable belief to deny a visa exists.  A visa denial by a consular officer will be followed by an explanation in most instances.  There is a very limited judicial review of such denials.

IMMIGRANTS

Family-based immigration involves petitioning for immediate family members currently outside of the United States. Preference categories have been established and general wait times following the approval of an I-130 beneficiary petition are routinely published.  Because such wait times are often ridiculously long, it makes sense to file such a petition as soon as possible.  The DS-230 Part I and Part II are required forms on behalf of the beneficiary, after the petition has been approved or priority date arrived at, and they will be sent from the National Visa Center. Petitioner will have to file an Affidavit of Support (form I-864) to show adequate financial support in the United States so that the beneficiary will not become a public charge.

At Consular Interview, one will need the birth certificate or certificate of citizenship of petitioner, marriage certificate of petitioner and beneficiary, any divorce decree, if the petition is for a brother or a sister, marriage certificate of parents of petitioner and the beneficiary, alien’s photograph, alien’s passport, alien’s I-94 Arrival and Departure card, medical exam of the alien, and a police clearance letter.  The Marzec Law Firm is happy to assist you in any of the above matters.  Please contact us today.
