FEDERAL LITIGATIONCertain immigration cases require that we go to federal court for relief. In some cases, you may challenge a deportation or removal order based on constitutional or federal statutory ground. Also, if you filed a benefit application such as Naturalization or adjustment of status / green card and have not heard from the USCIS, you may compel adjudication of your application. You may challenge a denial of a Naturalization application (for example, where the USCIS denies an application by improperly looking outside the 5 year terms before filing of the application in determining “good moral character.”) Finally, if you were detained by immigration officials, you may challenge such an unlawful detention in federal court.
Please keep in mind that some discretionary relief denials may not be challenged in federal courts. For example, adjustment of status, cancellation of removal, and a waiver of deportation are all discretionary, hence not reviewable by federal courts.
