M-VISAFull time vocational / Community College students may receive the M-visa. It is possible to change status to an F-1 visa within the first six months of studies (usually at the same time as changing schools). The M-visa is issued up to one year (with available extension if you are not able to finish your studies within the I-20M date done through filing the form I-539). The M-visa holders may work for up to six months after completion of the studies, but such a job must be in the area of study. The M-visa eligibility requires that the applicant be accepted to the school, and such an applicant is unable to change the course of study therein. An M-1 student may not change status to an H classification if the training received as an M-1 helped him or her qualify for H status. However, transfer to another school during the first six months and change of status to F-1 is permitted. Accompanying family members may not work in the U.S. After the end of studies or of the practical training, M-1 holders have 30 days to leave the U.S. (the school informs USCIS that one has completed the course of study).
Before a school issues you the I-20M-N form, you must bring the application for admission, proof of payment for the application, diplomas, including their English translations, transcripts, TOEFL results, and photos. The school may also ask for a tuition deposit, copy of an apartment lease, recommendation from a professor, immunization records, and proof of health coverage.
During your consular interview, you must bring school issued documents- form I-20M-N / I-20ID (Certificate of Eligibility), a letter of acceptance, proof of health insurance, and immunization records. During the interview, you may be required to show that you are a home owner at your home country, that you have a well-paying job, etc., to make sure that you do not have an immigrant intent.
The Marzec Law firm may assist you in the process of applying for an M visa or in the process of changing your status. However, when it comes matters of student visas, you should first consult your school's foreign students' officer whose job is to assist you in this process. To schedule a consultation with our firm, please contact us.
